National Healthcare Decisions Day

It's been 10 days since April 16th marked this year's National Healthcare Decisions Day. Our firm recognized this important day with our 4th Annual Event, held at The Atrium in Boca Raton, on the 14th. Members of the senior healthcare community attended with interest and received an event packet that covered the need for Advance Directives. Guest speakers presented points of view on the delicate subject of End of Life Decision-Making from legal, moral and spiritual perspectives, and "Having the talk."

What is an advance directive?


What if something happened to you and you couldn't make your own decisions.....


Advance Directives are a suite of documents that assign "Power" to someone you trust who will make legal, financial and medical decisions on your behalf, should you become incapacitated and unable to read, speak, write, think logically for yourself.
All adults can benefit from thinking about what their healthcare choices would be if they were unable to speak for themselves.  These decisions can be written down in an advance directive so that others know what they are.  Advance directives come in two main forms:
  • A "healthcare power of attorney" (or "proxy" or "agent" or "surrogate") documents the person you select to be your voice for your healthcare decisions if you cannot speak for yourself. 
  • A "living will" documents what kinds of medical treatments you would or would not want at the end of life
And very improtant: The Durable Power of Attorney. When done correctly and comprehensively, and by a Board-certified Elder Law attorney, enables one to designate a person or persons who will be able to act on your behalf with regard to banking, real estate and other business transactions. In the best case scenario, you would assign someone you KNOW will always have YOUR best interests in mind.

Having the talk: nobody likes to think of the worst...or even the inevitable. But, on too many occasions, folks have suddenly become incapacitated and their loved ones are left powerless and unable to follow-through with certain plans and decisions that may have been communicated-verbally.


Think ahead and get it in writing.


According to the NHDD, here are some impressive stats on how many people, participated in events across the country and received information on this important matter:
  • Over 626,000 medical staff members, employees, or organization members received either specific education on advance directives.
  • Over 35,000 people attended public NHDD events.
  • Over 1,800 advance directive documents were known to be executed.
  • NHDD was mentioned in media all across the country.

Taking Care of the Caregiver

When someone in our life finds themselves a caregiver for an Alzheimer’s patient, they have two challenges: dealing with the patient and dealing with the isolation.

Here are a few tips for being a good friend:  Don’t brag about the wonderful things in your life...too much
  • Be sensitive to last minute changes of plans
  • Do not minimize anything they are experiencing
  • Help with errands (Duh!)
  • Bring food
  • Stay in touch and keep including the person even if they often refuse
    (unless told otherwise)

My Story

My story for these Passover and Easter Holidays

Most of the year, I come to you with information on what we can do as an elder law office. We encourage you to use our services and recommend them to your friends, colleagues and clients. We provide you with important legal, financial and practical information regarding the elderly. We are proud of the good work we do.
 
As a holistic elder law firm, we provide a tremendous amount of financial security and personal peace of mind with the services we provide and the staff that provides them with me and with whom I could not do without. Unlike many attorneys, I feel good about what I do every day and enjoy coming to work. I’m extremely grateful for having found what I believe to be a true calling.
Sometimes, however, I am struck with the awareness that I cannot change certain facts: that I cannot make my client remember, walk, be pain free or young again. I could not do it for my in-laws who both passed away 3 years ago and I cannot do it for my parents, who are struggling with all the issues of aging you all see every day.


Sometimes, this powerlessness is frustrating, humbling and sad.


And then just as I mull over what I cannot do, I find myself working with a hospice, social worker or a veteran’s service officer or a CNA at a nursing home and I realize that those of us who are privileged to work with seniors and their families in later years and in end of life situations are among the most special people out there. Most people could never do what we do, day in and day out.


"Isn’t what you do depressing?" people ask me. And my response is an emphatic NO. It just reminds me that every day is a gift to be treasured.


So during this time for reflection and time spent with family, I wish you peace, love, strength and acceptance for whatever comes your way.

Happy Holidays

Aunt Gertie

My Aunt Gertie died on December 6, 2010 on the cusp of 91. She was the last of my father's siblings to pass away. So now both my parents have no living brothers or sisters.
She was my last surviving aunt.
I did not have grandparents. I was not even five years old when they were all gone. But my parents were each the youngest of five children, so I had plenty of wonderful and loving aunts and uncles who were like "substitute" grandparents.
Aunts and Uncles are great. No baggage, no issues, no responsibilities. They cheer you on, happy to see you always and save the baggage and issues for their own kids. What a joy! How I will miss that!
My parents are both living and are now the last surviving aunt and uncle to all my cousins. My parents are everyone's "Aunt Rose and Uncle Joe". No baggage, no issues, no responsibilities. Even friends used to call them that because my cousins and I used to hang out together. At my parents' 60th wedding anniversary, one of my cousins said that "everyone needs an Aunt Rose and Uncle Joe". And so everyone does.
How extraordinarily blessed I am to still have my parents, aged 89 and 88. Yet I feel somehow gypped at having no "Aunt Rose or Uncle Joe". 
So Aunt Gertie, I will take my memories, all the more bittersweet because you were my last, and treasure them because all I had to do was show up.
So, my message to you is: to show up. For your aging mothers, fathers, unts & uncles...sisters and brothers. No regrets. Because when they are gone...

Lessons from a Winner

I recently had the privilege of hearing Cal Ripken Jr. speak at a conference I attended. If you are not a baseball fan, Cal Ripken holds the record for most consecutive baseball games played - 2632.  Baseball plays 162 games a year so you do the math! We're not likely to see this record broken anytime soon. 

For the new year, let me share with you just a few of the lessons he passed on to us that he credits to his remarkable success:
  • Passion: Love what you do.
  • Consistency: Be prepared to perform every day.
  • Conviction: Have a thick skin.
  • Strength: Both physical and mental.
  • Balance: In work and life.
I like to think that my approach to the practice of Elder Law embodies these principals. National Velvet and National Tragedy

It’s easy to think that with the passing of the legendary Elizabeth Taylor that the last of Golden Era of movies has left us.  Not true.  Kirk Douglas just appeared at the Oscars and Olivia de Havilland and Joan Fontaine are still feuding sisters.
           
Another star of the Golden Era and Elizabeth Taylor’s costar in National Velvet has also been in the news, but for reasons that boggled my mind.

Mickey Rooney recently made news in a sad way: He got a restraining order against a family member who was allegedly taking advantage of him, leading Rooney to another star turn: testifying before Congress this month on elder abuse.

Elder abuse, neglect and exploitation can happen to anyone.  Mickey Rooney is proof of this.  The victim can be perfectly competent and the last one we might expect to be a victim. 

EVERYONE in the State of Florida who suspects that an elder is subject to abuse, neglect or exploitation must report this.  The report is made by calling 1-800-96-ABUSE.

Rosie the Riveter

On the wall next to the Resource Center in our office are three  posters: One of the NYC Subway System (before 9/11), one of Woodstock, the other of Rosie the Riveter. 

The inspiration for the “Rosie the Riveter” picture passed away recently.  Geraldine Hoff Doyle was 17 years old when that picture was taken and the banner “We Can Do It!” was not only a symbol of women’s power during the war but has become a symbol and inspiration for women for almost 70 years. 

“We Can Do It!” has been reproduced frequently on a variety of items and has become a symbol of women’s power for almost 70 years.  70 years ago I couldn’t have even considered becoming a lawyer. There were many women during the “women’s lib movement” who paved the way for those of us who came after but let’s not forget the contribution of those women who contributed so faithfully during the war effort.  They allowed the men to fight the war and sewed the seeds for the women’s movement that followed.

Not surprisingly, these “non-veteran” women do not enjoy the veteran’s benefits of the actual war veterans.  However, if they are the surviving spouse of a war time veteran, there is funding for some long term care.

“Until you’ve walked a mile in someone’s shoes” is the first thing that comes to mind.

I have been hospitalized two times since September.  Nothing life-threatening thank goodness and I seem to be on the mend and counting my blessings daily.

During each hospital stay, there was the obvious frustration of simply being sick, in the hospital and not knowing what was wrong.  For me personally even greater than the physical issues, was the angst of millions of thoughts going through my mind: What did that doctor just say to me?? (as he sprinted in and out of the room as if he had a bus to catch). 

I am in extreme distress and it was hard to process what he was telling me about my situation.  I have to call my daughter to bring me my clothing and take care of the dog.  Will her employer be ok with her having to leave work?? (My 24 year old daughter does not live with me and has demands and responsibilities of her own).

What if this illness is serious??  What if they cannot find out what is causing this problem??  What am I going to do about my job?  Will I be able to work?  I live alone - how am I going to care for myself until my health improves??  WILL my health improve??  The conversations in my head and real fear in my spirit went on and on.

Many of us are professionals who are committed to the care and quality of life for our frail and elderly and we have all likely done the “senior sensitivity training” which is invaluable to better understand the challenges of aging.  What I was not prepared for were the real-life challenges and responses from others as a result of those challenges which I had to face.  For the first time I really noticed the impatience as I drove a little slower or had difficulty navigating through a grocery store with a cane.

I was also very aware of being dependent on those around me for even the simplest things and also my self-imposed but very real shame and humiliation for having to ask for assistance with those tasks, feeling like a child at times.  After all, in my private and professional life, I was the one providing the assistance and not the one needing it.

There is now a new and special level of support I can provide our clients because I feel I truly have walked a mile in their shoes.

1980: Bridging Traditional Estate Planning With Real World Needs

Estate Planning is like life.  It is continually evolving.

Let’s take a trip to 1980:

1.         Life expectancy in 1980 was 74. (Now 78 (80 for women)).

2.         Estate Taxes were paid on estate of over $161,000.
            It was $600,000 for ten years  from 1987-1997. 
           
It is now $5 million!

3.         Probate was a real concern since, unlike today, many assets
            (especially stocks and bonds) could not be tilted with a
            beneficiary or “payable on death” and probate fees and
            costs could run into the thousands.

4.         Durable Powers of Attorney were not routinely used until the
            first major legislation enacted in 1995.

5.         Health Care Surrogates came into being in1998. Before that
            we had just a Living Will. The modern living will was enacted
            in 1992. Health Care Surrogates were enacted in 1998 with
            major changes in 2001 and 2005.

6.         1 out of 2 Americans over 85 has Alzheimer’s disease.  The
             rate has tripled since 1980. 

Elder Law grew out of the need to bridge traditional estate planning with real world needs. And in the real world the biggest financial crisis facing Middle Americans are the cost of long term care needs.  Planning on how you will leave your estate is worthless if there is not estate to leave because it was eaten up in the last years of our life.

Since traditional estate planning attorneys often do not concentrate on preparing for long term care needs, we are confronted with “stale” estate plans that are not only ill suited for the needs of the client but can actually be extremely problematic.  (We have had to go to court many times to “reform” documents of deceased spouses.)

The average “long goodbye” for an Alzheimer’s patient is 10 years.  The human toll and the financial costs are staggering.  Preparing for both of these inevitabilities can save on both the human and financial tolls.

The Tucson Tragedy

The Tucson shootings of Rep. Gabrielle Giffords and others is still fresh.  I hope you will allow me to let this tragedy be an opening to remind us all of the necessity of Advance Care Planning.  For our current clients it reminds why they have executed a Durable Power of Attorney, Health Care Surrogate and Living Will, and why all their loved ones and your family and network need to get one – now.  Sometimes serious medical events are completely unexpected. 

The Virginia Tech shootings were also of an illustration of parents being unable to get information about their “adult” children because there was no power of attorney on record. 

And what Floridian can forget Terri Schiavo and what can happen if a person does not have written directives; or Anna Nicole Smith, who did not put her funeral wishes in her will or a “separate writing”

It  also reminds us of the importance of  “having the talk” with our families to discuss out wishes, so that their designees can function more capably as health care agents in the event of a sudden medical challenge down the road.  Use these unfortunate opportunities to bring up these obviously unpleasant issues

While we keep the victims of this tragedy in our hearts and prayers, you can also try to make a trace of good from it by using these stories to get a conversation started.

Valentine’s Day and Alzheimer’s Disease

The day we celebrate love is today, and for our loved ones and clients with Alzheimer’s the simple pleasures can make ideal gifts. 
Some ideas and tips....
Whatever you do, make it in the moment:
- Give a gift that gives immediate joy, from and emotional or sensory perspective.
- Bring favorite foods, wrapped up pretty paper, and enough to share with others.
- Soft clothing, blankets provide pleasure and security.
- Look at old photos, listen to old music.
- If possible, have the individual recollect their first love.
We understand that these things may not be appropriate for everyone's situation, but traditions  do endure because our long term memory outlives our short term memory.

Family Members with Special Needs

We often don’t think of Elder Law and Estate Planning when we talk about planning for the disabled.  In fact, planning for someone with a disability is a large part of many elder law and estate planning practices.

All parents who have a child with special needs should do real planning such as purchasing life insurance, having a trust, doing a life care plan etc.  That is because the central issue in planning for someone with special needs is leaving the individual money in a way that will not interfere with any public benefits (such as Medicaid) the individual is receiving.  Often persons with special needs have high medical bills and Medicaid is crucial to their good care.

But grandparents and other family members need to also be mindful that the gifts they may give during lifetime, or at their death, can interfere with public benefits and really mess up the grandchild’s benefits and the parents’ plans.  That’s why we encourage parents to also coordinate with other family members who may want to provide for the individual with special needs.

Family members can provide for their disabled family member by creating a Special Needs Trust.  They are a great tool for ensuring that the public benefits are protected; and yet not disinheriting the individual, as we would have done before Special Needs Trusts.  They are called “Special Needs Trusts” because the document will ordinarily provide that the assets be used only for needs above and beyond what public benefits provide. They are, however, flexible documents and are tailored to your family’s unique circumstances.

Baby Wake Up! Getting Old Without Feeling Old

Author Calvin Hill has released his new book "Staying Fit After 60: Introducing the Exercise for Life Program" to share the health and life-saving benefits of the program he has developed. He puts it bluntly: "This book is telling seniors, you can get old without feeling old."
So what’s so special about this book?  Mr. Hill waited until he was 76 years old to write it."I had to have indisputable and irrefutable proof as to the value and the beneficial results of this exercise program." Why is this so important?  Well Baby Boomers it’s time to wake up!


Thanks to the Baby Boomers (including myself), there are now almost 80 million people in this country who are approaching 60 and over, with over 250,000 Baby Boomers turning 60 every month - more than three million per year. Because of the lack of exercise, Alzheimer's and dementia are claiming more seniors than ever before.


Recent studies have shown, seniors who exercise 20 minutes a day 4 to 5 times a week will have a 30% to 40% less chance of developing Alzheimer's and dementia. There will have been almost two million hip and knee replacements performed by the year 2015, that number will increase to be almost four million hip and knee replacements by the year 2020. Some of these operations could have been prevented or avoided if one had been using the Exercise for Life Program.

When Your Dad Turns 90

My Dad just turned 90 years old.  He is sharp as a tack and despite being overweight and having a slew of health problems, eats ham, bacon or sausages every day.  At 80 I stopped telling him what to eat.  I figured he gotten this far without my help.

He and my mom have a full time aide and so I am personally familiar with everything my clients are experiencing.  My dad has been in the hospital and rehab, my mother broke her hip 2 years ago. 

During a recent visit by my son, Dad asked his grandson to try on his army uniform from WW2.   As you can see from this photo, dad has gained some weight over the years.  However, what he has also gained is insight into his years of service.  He would never talk about it when I was growing up but with my son, he is very open. (Grandchildren can get anything!).  We found out that my father was in the units right behind the ones that liberated one of the camps.  He also has some fun stories that he very much likes to share.
